Extrajudicial enforcement of claims
With the consent of both parties, consumers are entitled to extrajudicial enforcement of claims and to vindicate their claims before permanent conciliation consumer courts under the auspices of the Provincial Inspectorates of the Trade Inspection. Information on the rules concerning the access to this procedure can be found on the websites of the Provincial Inspectorates of the Trade Inspection or on the website of the Office of Competition and Consumer Protection (www.uokik.gov.pl).
The ODR platform
As of 15 February 2016, consumers are entitled to extrajudicial enforcement of claims by electronic means, via the European Union ODR online platform.
The platform helps consumers to vindicate their claims arising from or related to online sales agreements or service agreements (within the meaning of the Regulation (EU) No 524/2013 of the European Parliament and of the Council of 21 May 2013 on online dispute resolution for consumer disputes and within the meaning of the amendment of Regulation (EC) No 2006/2004 and of Directive 2009/22/EC) concluded between consumers living in the EU and entrepreneurs based in the EU.
