GENERAL TERMS AND CONDITIONS OF SPECIAL OFFERS

The following Terms and Conditions (hereinafter referred to as “Terms and Conditions“) define the general rules of special offers provided from time to time by TME US, LLC, a limited liability company of the State of Georgia, USA (hereinafter referred to as "TME").
Special offers provided by TME may include:
a) special prices – i.e. lowering prices of all or selected products currently offered by TME during the period of validity of such special offer;
b) special offers on shipping fees – i.e., whereby TME may, in part or in full, cover certain shipping fees for goods of a particular value purchased during the period of validity of such special offer;
c) special gifts – i.e., gifts provided to the customer by TME after purchasing products from a selected category or products of a particular value currently offered by TME;
d) after the customer satisfies certain conditions and/or TME grants a discount code for the customer’s next purchase from TME.
Special offers shall be provided by TME in accordance with the principles set out in these Terms and Conditions, which can be amended by TME in announcements provided in the "Special offers" section on the website www.tme.com/us/en-us/, sent via TME Newsletter, sent via e-mail, or published in other forms. Should the terms of a particular special offer differ from the rules defined in these Terms and Conditions, its conditions shall be defined in a separate terms and conditions document.
An announcement of a special offer may set forth in particular its character, conditions for participation, timeframe, territorial scope, and the specific TME customers to whom the offer is applicable.
Each special offer shall have a timeframe provided in its announcement. TME reserves the right to cancel or modify any special offer at any time for any reason.
A special offer can be used at only during its period of validity.
Participation in special offers is free of charge and voluntary.
Participation in special offers is open to individuals and entities, provided that such individuals and entities have the necessary legal capacity (hereinafter referred to as a "Participant"), after the Participant satisfies all of the following conditions:
a) The Participant has read and accepted in full the provisions of these Terms and Conditions;
b) The Participant has a place of residence or registered office in the territory covered by a particular special offer which is available only in a limited territory;
c) The Participant is included in the defined group of TME customers to whom the particular special offer is addressed, in case of special offers applicable only to selected categories of customers;
d) The Participant has satisfied all the conditions of eligibility for the special offer, as may be set forth in the announcement and in these Terms and Conditions;
e) The Participant enters into a sales or delivery agreement with TME for the purchase of goods as set forth in TME's offer, and executes the relevant agreements, and such is not prohibited by applicable law.
Unless the announcement for a special offer states otherwise, special offers are applicable to customers placing orders in any form made available by TME.
Should the Participant be granted a discount code for their next purchase at TME, the validity period of such code and the rules of redeeming it shall be defined in the announcement of the special offer.
A special offer cannot be combined or used with one another special offer or with any other discounts, including individual discounts, unless the detailed terms and conditions of a given special offer expressly states otherwise.
Special pricing or discounts in special offers do not apply to shipping fees, unless the contents of the announcement expressly state otherwise.
For special offers concerning TME granting a gift to the Participant after satisfying certain conditions, the Participant is eligible to receive any such gift only once. The gift shall be added to the parcel with the goods ordered, or delivered to the Participant in a separate parcel at the expense of TME. Should the Participant withdraw from such agreement or order, or seek to a refund and return of such goods, the Participant is required to return such gift along with the returned goods, in accordance with the TME’s rules stipulated by law.
All sales of goods covered by a special offer are subject to TME’s Terms of cooperation, published at the TME website at www.tme.com/us/en-us/ unless otherwise expressly agreed to in writing by TME on an individual basis.
Participation in a special offer is a confirmation that the Participant has read and accepted the announcement of the special offer and these Terms and Conditions.
To the extent permitted by applicable law, any legal obligations resulting from these Terms and Conditions are governed in accordance with the internal laws of the State of Georgia .
TME reserves the right to alter the provisions of these Terms and Conditions as well as terms and conditions of a particular special offer for any reason. Any such alterations of any provisions of these Terms and Conditions shall be included in the form of an addendum or appendix to these Terms and Conditions, which shall be an integral part of these Terms and Conditions.
